Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and runab ("Company," "we," "us," or "our") governing your access to and use of the runab website, platform, and services (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.

You represent that you are at least 16 years of age and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Service

runab is an A/B testing platform that enables users to:

  • Create and manage A/B tests for websites
  • Split traffic between test variants
  • Track conversions and analyze results
  • Make data-driven decisions about website optimization

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

3. Account Registration

3.1 Account Creation

To access certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activities that occur under your account

3.2 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials. We are not liable for any loss or damage arising from your failure to protect your account information. We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised.

4. Subscription Plans and Pricing

4.1 Available Plans

runab offers the following subscription plans:

  • Free Plan: $0/month — 1 site, 1 running test, unlimited visitors
  • Indie Plan: $9/month — 3 sites, 3 running tests, unlimited visitors, email support
  • Pro Plan: $29/month — 10 sites, 10 running tests, unlimited visitors, priority support

All plans include unlimited visitors, unlimited draft tests, and core A/B testing features. Plan limits apply to running tests only; completed and draft tests do not count toward limits.

4.2 Pricing Changes

We reserve the right to modify our pricing at any time. Any price changes will be communicated to you at least 30 days before they take effect. Your continued use of the Service after price changes constitutes acceptance of the new pricing. Existing subscriptions will be honored until the end of the current billing period.

5. Payment Terms

5.1 Payment Processing

All payments are processed through our third-party payment processor, LemonSqueezy (Lemon Squeezy, LLC). By subscribing to a paid plan, you agree to LemonSqueezy's Terms of Service and Privacy Policy.

LemonSqueezy acts as the Merchant of Record for all transactions. This means LemonSqueezy is responsible for:

  • Processing all payment transactions
  • Handling sales tax, VAT, and other applicable taxes
  • Managing billing disputes and chargebacks
  • Compliance with payment card industry standards (PCI-DSS)

5.2 Billing Cycle

Paid subscriptions are billed on a monthly recurring basis. Your billing cycle begins on the date you subscribe to a paid plan. You will be charged automatically on the same date each month unless you cancel your subscription.

5.3 Payment Methods

We accept payment methods supported by LemonSqueezy, including major credit cards (Visa, Mastercard, American Express), debit cards, and other payment methods as available in your region.

5.4 Failed Payments

If a payment fails, we will attempt to process the payment again. If payment cannot be processed after multiple attempts, your subscription may be downgraded to the Free plan or suspended until payment is resolved. You are responsible for ensuring your payment information is current and valid.

5.5 Taxes

All prices are exclusive of applicable taxes unless otherwise stated. LemonSqueezy will calculate and collect any applicable sales tax, VAT, GST, or other taxes based on your location. You are responsible for paying all taxes associated with your subscription.

6. Refunds and Cancellation

6.1 Cancellation Policy

You may cancel your subscription at any time through your account settings or by contacting us. Upon cancellation:

  • Your subscription will remain active until the end of your current billing period
  • You will not be charged for subsequent billing periods
  • Your account will be downgraded to the Free plan at the end of the billing period
  • Your data will be retained according to our data retention policy

6.2 Refund Policy

We offer refunds under the following circumstances:

  • 14-Day Money-Back Guarantee: If you are not satisfied with your paid subscription, you may request a full refund within 14 days of your initial purchase or upgrade.
  • Service Issues: If the Service is materially unavailable or non-functional for an extended period due to issues on our end, you may be eligible for a prorated refund.

Refund requests should be submitted to support@runab.io. Refunds are processed through LemonSqueezy and may take 5-10 business days to appear on your statement.

7. Acceptable Use Policy

You agree not to use the Service to:

  • Violate any applicable laws, regulations, or third-party rights
  • Engage in fraudulent, deceptive, or misleading activities
  • Distribute malware, viruses, or other harmful code
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the Service or servers connected to the Service
  • Scrape, crawl, or use automated means to access the Service without permission
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service to send unsolicited communications (spam)
  • Collect or harvest personal information of other users
  • Impersonate any person or entity
  • Use the Service for any illegal or unauthorized purpose

We reserve the right to investigate and take appropriate action against anyone who violates this policy, including removing content, suspending or terminating accounts, and reporting to law enforcement authorities.

8. Intellectual Property

8.1 Our Intellectual Property

The Service, including its original content, features, functionality, design, and underlying technology, is owned by runab and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our prior written consent.

8.2 Your Content

You retain ownership of any content you submit, post, or display through the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content solely for the purpose of providing the Service.

8.3 Feedback

If you provide us with feedback, suggestions, or ideas about the Service, you grant us the right to use such feedback without restriction or compensation to you.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our collection and use of data as described in the Privacy Policy.

You are responsible for ensuring that your use of the Service complies with all applicable data protection laws, including obtaining necessary consents from your website visitors for the use of cookies and tracking technologies.

10. Third-Party Services

The Service may integrate with or contain links to third-party services, including but not limited to:

  • LemonSqueezy — Payment processing
  • Supabase — Infrastructure and database services
  • Vercel — Hosting services

Your use of third-party services is subject to their respective terms and conditions. We are not responsible for the content, privacy practices, or availability of third-party services.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free
  • The results obtained from using the Service will be accurate or reliable
  • Any errors in the Service will be corrected
  • The Service will meet your specific requirements

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RUNAB, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of (or inability to access or use) the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless runab and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including but not limited to your User Content, any use of the Service's content, services, and products other than as expressly authorized in these Terms.

14. Termination

14.1 Termination by You

You may terminate your account at any time by using the account deletion feature in your settings or by contacting us at support@runab.io.

14.2 Termination by Us

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

  • Breach of these Terms
  • Fraudulent, abusive, or illegal activity
  • Non-payment of fees
  • Extended inactivity
  • Upon your request

14.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

15.2 Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiations. If the dispute cannot be resolved through negotiations within 30 days, either party may pursue binding arbitration or litigation as provided below.

15.3 Arbitration

You agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be settled by binding arbitration, except that each party retains the right to seek injunctive or other equitable relief in a court of competent jurisdiction. The arbitration shall be conducted in accordance with the rules of the American Arbitration Association.

15.4 Class Action Waiver

YOU AND RUNAB AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last updated" date. For significant changes, we will provide additional notice via email or through the Service. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the new terms, you must stop using the Service.

17. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.

18. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices or agreements published by us on the Service, constitute the entire agreement between you and runab concerning the Service and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written.

19. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of runab.

20. Assignment

You may not assign or transfer these Terms or your rights under these Terms, in whole or in part, without our prior written consent. We may assign these Terms at any time without notice or consent. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties, their successors, and permitted assigns.
